Terms of Service
These Terms of Service ("Terms") set out the conditions for using Nativa (the "Service"). Please read them carefully before using the Service.

Article 1 (Application)
These Terms apply to all relationships concerning use of the Service provided by SBC TRADING CO., LTD (the "Company"). By starting to use the Service, the customer is deemed to have agreed to these Terms.
Article 2 (Definitions)
- Service: a service that automatically translates messages in LINE and WhatsApp group chats and posts the translated text back into the same group.
- Customer: an individual who registers an account for the Service and uses it.
- Target group: a group chat the customer has linked to the Service with the in-chat
/bindcommand. - Linked account: the LINE account or WhatsApp account the customer has linked to the Service.
- Target platform: LINE and WhatsApp, both services provided by third parties other than the Company.
Article 3 (Account Registration)
- The customer registers an account with an email address and password, or by LINE Login.
- If any registered information is found to be false, the Company may suspend use of that account.
- The customer is responsible for managing their account and password. The Company bears no responsibility for outcomes arising from use by a third party.
- An account may not be transferred, lent, or shared with anyone else.
Article 4 (Content of the Service)
- The Service translates messages posted in a target group into the language the customer has configured, and posts the result back into the same group.
- Because translation uses the surrounding conversation as context, several messages are processed together. As a result, there is a delay of several seconds between a message being posted and its translation appearing.
- Translation settings (target languages, enabling/disabling, unlinking) are configured through in-chat commands and the Service's dashboard.

Only the customer who ran
/bindon a target group may change that group's settings. Commands from any other participant are not accepted. - Translation is performed using a third-party generative AI (large language model). See the Privacy Policy for details.
Article 5 (Notice to Participants of the Target Group)
- Once the Service is enabled, messages in the target group are processed for translation. Before linking a group, the customer is responsible for notifying that group's participants that the Service is in use and for obtaining any necessary consent.
- The customer must make these Terms and the Privacy Policy available for the target group's participants to review.
- To stop translation, run
/unbindin the target group. Messages in that group will no longer be processed afterward.
Article 6 (Special Provisions for WhatsApp Integration)
Because WhatsApp has no official bot facility for groups, the Service operates by linking the customer's own WhatsApp account (the "bring your own account", or BYOA, method). The customer links their account only after understanding and accepting each of the following.
- Translated text is sent from the customer's own account, not from the Company.
- Automated sending carries risk under WhatsApp's own Terms of Service, and that risk rests with the customer's own WhatsApp account. The Company bears no responsibility for any warning, restriction, suspension, or other action imposed on that account.
- Avoid linking an account you use for important communications.
- A linked device is unlinked once the phone has been offline for a certain period (roughly 14 days, per WhatsApp's own specification), after which the QR code must be scanned again.
- The link can be removed at any time from the Service's dashboard.
Article 7 (Prohibited Acts)
When using the Service, the customer must not do any of the following.
- Acts that violate laws, regulations, or public order and morals.
- Acts that violate the terms or guidelines of a target platform.
- Acts that infringe the rights of a third party (intellectual property, privacy, reputation, or other rights).
- Processing a conversation that should remain confidential for translation without notifying its participants.
- Placing excessive load on the Service's infrastructure, or mechanically sending a large volume of messages.
- Attempting to improperly manipulate the behavior of the Service or the translation engine (including prompt injection or attempts to obtain internal instructions).
- Reverse engineering, decompiling, or otherwise improperly analyzing the composition of the Service.
- Using another person's account or linked account without authorization.
- Reselling, transferring, or otherwise providing the Service to a third party (except where the Company has given written permission).
- Any other act the Company reasonably judges to be inappropriate.
Article 8 (Fees and Payment)
- The fees for using the Service, the payment method, and the scope and duration of any free offering are separately determined by the Company and shown within the Service.
- A paid plan is contracted against the customer's account as a rule, not against each target group individually.
- The order process and payment for paid plans are conducted by our online reseller Paddle.com, which is the Merchant of Record for all orders. Paddle charges the fees, collects any applicable tax, issues invoices and receipts, and processes refunds, and Paddle's buyer terms also apply. Refunds are governed by the Refund Policy.
- If use is suspended for a reason attributable to the customer, fees already paid will not be refunded.
Article 9 (Suspension of Use / Account Deletion)
- If the customer violates these Terms, or if the Company receives a request from a target platform, the Company may suspend provision of the Service or delete the account without prior notice.
- The customer may request removal of the link and deletion of their account at any time.
Article 10 (Changes, Suspension, and Termination of the Service)
- The Company may change the content of the Service and may discontinue providing it.
- The Company may interrupt the Service without prior notice for infrastructure maintenance, a failure, a specification change or outage of an external service (a target platform, a generative AI provider, a cloud provider, etc.), or another unavoidable reason.
- The Company bears no responsibility beyond the scope of Article 11 for any damage the customer incurs from a change, interruption, or termination under this Article.
Article 11 (Disclaimer)
- Translations are generated mechanically, and the Company does not guarantee the accuracy, completeness, or fitness for any particular purpose of a translation. Do not rely solely on translated text for important decisions in contracts, medical care, legal matters, or similar.
- The Company bears no responsibility for delay, omission, or non-delivery of a translated message caused by a target platform.
- Except where caused by the Company's own willful misconduct or gross negligence, the Company's liability is limited to the total fees the customer paid the Company in the preceding 12 months.
- The Company is not involved in, and bears no responsibility for, a dispute between the customer and a target group's participants, or between the customer and any other third party.
Article 12 (Intellectual Property)
Intellectual property rights relating to the Service belong to the Company or to its rightful holders. No right in the content of a message or its translation transfers to the Company.
Article 13 (Handling of Personal Information and Conversation Content)
The handling of personal information and message content, the retention periods, and provision to third parties are governed by the Privacy Policy.
Article 14 (Amendment of these Terms)
The Company may amend these Terms when it judges this necessary. A material change will be announced within the Service or by another appropriate method. Continuing to use the Service after a change takes effect constitutes agreement to the amended Terms.
Article 15 (Governing Law and Jurisdiction)
These Terms are governed by the laws of the Socialist Republic of Vietnam. Any dispute arising in connection with the Service that the parties cannot settle through negotiation shall be submitted to the competent People's Court of Vietnam having jurisdiction over the location of the Company's head office.
